A Will is a legal document that sets out how you want your estate to be distributed when you die. It can help to provide clarity, help to prevent family disputes and give greater control over what happen to your things after you are gone.
Nearly everyone has thought of making a Will at some point, but only 30% of us have actually done so. Even the most sensible of us often wrongly assume that making a Will is something that can be put off until tomorrow. Although it may not be something we like to think about, making a Will is one of the most important steps to protect your loved ones and ensure your wishes are respected after your death.
A Will can:
- Allow you to decide who inherits your Estate.
- Allow you to protect your children.
- Allow you to provide for your loved ones.
- You can reduce the risk of family disputes.
- Allow you to choose who will manage your Estate.
- Allow you to plan ahead for your financial legacy.
- Give your family peace of mind.
Unfortunately, the absence of a Will, or a self-written document, can mean instructions on how your estate should be dealt with are unclear and lack legal standing. This can lead to disputes over property, belongings and finance. By having a professionally written Will in place you will ensure your wishes are respected and will provide certainty for your friends and family.
If you die without leaving a Will, otherwise known as being intestate, your estate is distributed according to rules set out by statute which might not be in accordance with your wishes and so may not be appropriate for your estate.
This is an extremely stressful time for everyone involved and that is why having a Will in place is so important so that nothing can be left to chance.
Here are some of the issues that may arise if you die without leaving a Will (intestate):
- Your money and possessions may not automatically pass to your next of kin; there are rules which direct which family members inherit if their relative dies intestate.
- Relations who might be distant relations have to be traced which can lead to long delays, expense and hardship for the immediate family.
- At present, there is no automatic right to inherit in the intestate rules or in a statute for common law spouses to inherit the money and possessions
Whatever your age or financial circumstances, taking the time to put a valid Will in place can make a meaningful difference to the people you leave behind. The best time to make a Will is before you need one, by planning ahead, you can help to protect your loved ones and give yourself greater piece of mind.
